Avoid Probate and Sell Inherited Property Faster: What You Need to Know About California's AB 2016

Starting April 1, 2025, California homeowners and their families will benefit from a major change in the probate process, thanks to AB 2016. If you’ve inherited property in California, this new law could make it significantly easier to transfer and sell a primary residence.

Key Benefits of AB 2016 for Heirs and Sellers

  • No Probate for Homes Under $750,000
    Primary residences valued at or below $750,000 will no longer require probate, saving families time, money, and stress.
  • Faster Access to Property
    Estates can now use a Petition to Determine Succession to Real Property to bypass full probate proceedings. This applies to total estates valued up to $934,500 (including up to $184,500 in cash).
  • Applies to Deaths on or After April 1, 2025
    If a loved one passes away on or after this date, you may be eligible for this simplified process.
  • Key Requirements to Qualify
    • The property must have been the decedent’s primary residence.
    • All heirs must sign court documents.
    • A probate referee must appraise the property.
    • You must wait at least 40 days after the date of death before filing.
